Estate Litigation

Sometimes estates end up going to court. Whether you are a beneficiary or an executor, we may be able to represent you. 


We evaluate each situation on a case-by-case basis. If you would like to discuss your situation with Lynne Butler, please contact us to arrange a consultation. We cannot guarantee that we will be able to take on your case. Litigation is not our main focus. In the event that your case proceeds to trial, we may discuss with you the option of adding a litigation lawyer from another firm as co-counsel.


If your case is one we feel we can help with, the fee for the consultation will be rolled into the fee for litigation. In a situation where we choose not to accept your case, the appointment will be billed as a one-time consult. If at all possible, we will try to direct you to another firm that could help you. Please note that if your case is not related to an estate, we will not schedule a consultation for you.


Estate litigation is billed at an hourly rate. If your situation requires that a legal brief or authority be printed, there will be a small fee per copy. However, we will not charge you for regular printing and photocopying.


The hourly rate for litigation is $350.00. All fees are subject to HST. This rate applies to all stages of the litigation process, including negotiation.


Litigation files are subject to a retainer fee. This is an amount that you pay upfront, and from which we withdraw funds to pay your invoices. The amount you pay into the retainer is kept in trust until it is needed. We will always provide you with an invoice for services prior to withdrawing any funds. When amounts are used to pay an invoice we will provide you with a receipt. Once all matters are concluded, any amounts remaining in the retainer after our final bill will be refunded to you.


We will provide you with a cost estimate for each step of the litigation process. The retainer fee is equal to 50% of this cost. The retainer may be paid using bank draft, money order, e-transfer, or cheque. We cannot accept credit cards or debit for a retainer.

Please note that we are not accepting any new litigation cases at this time, however, we are happy to provide you with a referral to another firm.
